These terms cover the OmniRecord account: sign-in, your account and team, and paying for hours. Each product (OmniScope and others) has its own terms for using that product, and those apply as well.

1. Who we are and who you are

OmniRecord is operated by Advanced Translations Technology, Inc. (DBA OmniRecord), a California corporation ("we", "us"), 5115 Douglas Fir Rd, Suite L, Calabasas, CA 91302. "You" is the person creating or using an account. If you use OmniRecord for a team, you confirm you are allowed to act for it.

2. Your account

  • You must be at least 18 and provide accurate information.
  • Keep your password and sign-in codes private. You are responsible for what happens under your account. Tell us at once if you think it has been misused.
  • One person, one account. Do not share sign-ins.
  • You can review the devices signed in to your account and sign any of them out.

3. Teams

A team is a group of people who share products and billing. Team owners and admins can invite and remove members, set roles, and manage the team's billing details. Members can see the team's name, its members and their roles. Removing someone from a team ends their access to the team's products.

4. Payments

  • Hours and other purchases are sold through OmniRecord and charged in US dollars. Prices are shown before you pay.
  • Card and bank details are entered on our payment processor's page. We store only a token and the last four digits.
  • You authorize us to charge the saved card or account you choose, including for automatic top-up if you turn it on. You can turn it off or remove a card at any time.
  • Taxes are added where they apply. If your team is tax exempt, keep its exemption details current.
  • Refunds and credits are handled as described in the product where you bought the hours and in any agreement with OmniRecord. Unused hours and refunds follow that product's terms.
  • If a payment fails we may pause purchases and automatic top-up until it is fixed.

5. Text messages

If you add a phone number and consent, we send sign-in and verification codes by text message. Message frequency varies, message and data rates may apply, reply STOP to opt out and HELP for help. Consent is not required to use OmniRecord or to buy anything. See the Privacy Policy, section 5.

6. Acceptable use

Do not break the law, interfere with the service or other people's use of it, try to get into accounts or systems that are not yours, probe or test the service without our written permission, use it to send spam or malicious code, or copy, resell or reverse engineer it except as the law allows.

7. Suspension and ending

You can stop using OmniRecord and ask us to close your account at any time by emailing privacy@omnirecord.com. We may suspend or close an account that breaks these terms, is used for fraud, or is unpaid, and will tell you why where we can. Records we must keep for legal, tax and security reasons stay after closing.

8. Ownership

OmniRecord and its software, design and marks belong to OmniRecord and its licensors. You keep everything you put into a product, as each product's terms and the OmniScope Privacy Policy describe. We give you a personal, non-transferable right to use OmniRecord under these terms.

9. Availability and changes

We work to keep OmniRecord available but do not promise it will be uninterrupted or error free. We may change or retire features, and we may update these terms. We will post the new version with its date and, for material changes, email account holders. Using OmniRecord after a change means you accept it.

10. Disclaimers and limits

OmniRecord is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, and neither we nor our suppliers are liable for indirect, incidental, special or consequential damages or lost profits, and our total liability for any claim relating to OmniRecord is limited to the amount you paid us through OmniRecord in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, and some places do not allow these limits, so they may not apply to you.

11. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Courts located in Los Angeles County, California have exclusive jurisdiction, and you and we consent to them, unless a separate written agreement with OmniRecord says otherwise.
