This Privacy Policy describes how Advanced Translations Technology, Inc., a California corporation (collectively, “Company,” “we,” “us,” or “our”) collect, use, process, disclose, retain, and protect information in connection with OmniScope, our websites, applications, software, customer-support services, and related services (collectively, the “Services”).

OmniScope is a professional transcript-review and editing technology designed for court reporters, scopists, transcription professionals, court reporting agencies, legal professionals, courts, governmental entities, and other authorized professional users.

This Privacy Policy applies to information that we process in our own capacity as a business or controller and, where applicable, information that we process on behalf of our business customers as a service provider, contractor, or processor.

Important: Because OmniScope may process recordings and transcripts containing information about witnesses, attorneys, litigants, court personnel, medical providers, experts, employees, family members, and other individuals who do not have a direct relationship with us, Section 5, Customer Content, is particularly important.

This Privacy Policy does not expand any obligation or create any warranty, representation, contractual right, or private right of action beyond those imposed by applicable law or expressly established in a separate written agreement with us.

1. Scope of This Privacy Policy

This Privacy Policy applies to personal information we collect through:

  • our OmniScope websites and applications;
  • OmniScope accounts;
  • communications with us;
  • sales and customer-support interactions;
  • billing and subscription administration;
  • website cookies and similar technologies;
  • product analytics, security, and diagnostic systems; and
  • recordings, transcripts, and other content submitted to OmniScope for processing.

This Privacy Policy does not apply to independently operated third-party websites, services, applications, or platforms that may be linked to or interoperable with OmniScope, except to the extent we expressly state otherwise.

2. The Different Roles We May Have

Privacy laws distinguish between businesses that determine why and how personal information is processed and businesses that process personal information on behalf of another organization.

Depending upon the circumstances, we may act as a business, controller, service provider, contractor, processor, or similar entity under applicable privacy law.

Information We Control

We generally determine the purposes and means of processing information such as:

  • account registration information;
  • business contact information;
  • subscription and billing information;
  • website activity;
  • sales inquiries;
  • customer-support communications;
  • security and fraud-prevention information;
  • product telemetry and diagnostic information; and
  • information concerning our direct business relationship with a customer or user.

For this information, we generally act as the business or controller.

Information We Process for Customers

When a court reporter, scopist, reporting agency, law firm, court, governmental entity, or other customer submits recordings, rough transcripts, case material, speaker information, or other proceeding-related content to OmniScope, the customer ordinarily determines why the information is being processed.

In those circumstances, we generally process the information on behalf of the customer and may act as a service provider, contractor, or processor.

Where we act on behalf of a customer, that customer's privacy policies, notices, instructions, legal obligations, and agreements with us may govern the processing of the information.

We do not necessarily collect every type of information described above from every person.

4. Sources of Personal Information

We may obtain personal information directly from users; from organizations that purchase or administer OmniScope accounts; from authorized court reporters, scopists, employees, contractors, or other users; from payment processors and business-service providers; automatically through websites, devices, browsers, cookies, logs, and similar technologies; from integration partners when authorized; and from other lawful sources associated with providing or administering the Services.

With respect to Customer Content, we generally receive information from the customer or an individual authorized by the customer.

We are not responsible for independently determining whether a customer had authority to collect, record, possess, disclose, or submit Customer Content to OmniScope.

5. Customer Content

“Customer Content” means recordings, audio, audiovisual material, rough transcripts, transcript files, speaker information, case information, notes, dictionaries, annotations, corrections, exhibits, metadata, and other content submitted by or on behalf of a customer for use with OmniScope.

Customer Content may contain highly confidential information and personal information concerning individuals with whom we have no direct relationship.

Customer Responsibility

The customer that submits Customer Content is responsible for determining whether it has the right and authority to collect, record, possess, upload, transmit, disclose, and process that information through OmniScope.

Customers are responsible for complying with applicable recording laws, privacy laws, professional obligations, court orders, protective orders, confidentiality obligations, client requirements, and other restrictions applicable to Customer Content.

The technical ability to upload information to OmniScope does not mean that uploading the information is legally permissible.

How We Process Customer Content

We may process Customer Content as reasonably necessary to provide the Services requested by the customer, including:

  • receiving and storing files;
  • transmitting files for authorized processing;
  • converting audio or transcript formats;
  • performing speech-to-text processing;
  • performing transcript and audio alignment;
  • performing speaker-related processing;
  • generating machine-produced transcript comparison information;
  • identifying potential discrepancies between source material and rough transcript text;
  • generating Suggested Edits;
  • displaying Customer Content within OmniScope;
  • saving editing decisions;
  • synchronizing audio and text;
  • providing customer-requested technical support;
  • maintaining service reliability and security;
  • diagnosing technical problems; and
  • performing other processing reasonably necessary to provide OmniScope.

Machine Processing

OmniScope uses automated technologies, which may include speech recognition, artificial intelligence, machine learning, natural-language processing, diarization, alignment, and comparison technologies.

These technologies are used to assist professional transcript review.

OmniScope does not use Customer Content to independently certify the accuracy of a transcript, and automated processing does not replace the professional judgment of the court reporter responsible for the final transcript.

Voice Information

OmniScope may process human speech contained in recordings for purposes such as speech recognition, transcript comparison, speaker differentiation, and related service functions.

Unless separately disclosed and authorized, we do not process voice recordings for the purpose of establishing a biometric voiceprint used to uniquely identify a natural person.

Customer Content Is Not Advertising Data

We do not use Customer Content for cross-context behavioral advertising or to market unrelated third-party products to witnesses, litigants, attorneys, speakers, or other individuals appearing in Customer Content.

We do not sell Customer Content for monetary consideration.

Service Improvement

We may use Customer Content to test, maintain, troubleshoot, secure, evaluate, and improve the quality of the Services to the extent authorized by our agreement with the applicable customer and permitted by applicable law.

Where privacy law restricts the use of personal information processed by us as a service provider, contractor, or processor, we will limit such use in accordance with those restrictions.

We may also create statistical, aggregated, or de-identified information from usage and system activity. We may use information that is lawfully de-identified for product development, analytics, security, performance measurement, research, and other lawful business purposes.

We do not undertake to re-identify information that we are required by applicable law to maintain as de-identified.

6. Account Information

When an OmniScope account is created, we may collect information such as the user's name, email address, telephone number, employer or organization, username, password or authentication credentials, licensing information, subscription information, and administrative permissions.

We use account information to create and administer accounts, authenticate users, provide access to the Services, communicate about accounts, process subscriptions, provide customer support, maintain security, prevent misuse, and enforce applicable agreements.

Customers responsible for organizational accounts may have administrative access to information associated with users within their organization.

7. Billing and Payment Information

We may collect billing and transaction information necessary to administer subscriptions, invoices, usage charges, refunds, credits, taxes, and other payments.

Payment-card transactions may be handled by one or more third-party payment processors.

When a third-party payment processor handles a transaction, the processor may receive payment-card information directly. We may receive information such as a payment token, transaction identifier, card brand, expiration date, billing address, payment status, and the last digits of the applicable payment method.

We may retain transaction and billing records as necessary for accounting, taxation, audit, dispute resolution, fraud prevention, contract enforcement, and legal compliance.

Current payment processor(s): Nuvei (https://www.nuvei.com/who-we-are)

8. Cookies and Similar Technologies

Our websites and Services may use cookies, pixels, local storage, software development kits, session technologies, log files, and similar technologies.

These technologies may be used to:

  • maintain user sessions;
  • authenticate users;
  • remember preferences;
  • secure accounts;
  • prevent fraud;
  • measure website and application performance;
  • understand how features are used;
  • diagnose technical problems;
  • improve usability; and
  • perform website analytics.

Some cookies are necessary to provide the Services and cannot reasonably be disabled without affecting functionality.

Other cookies may be optional. Where required by applicable law, we provide mechanisms to manage nonessential cookies.

Browser controls may also allow users to block or delete cookies. Disabling cookies may affect some features of the Services.

9. Website Analytics

We may use third-party analytics providers to understand how visitors interact with our websites and Services.

Analytics information may include IP address, device type, browser information, operating system, referring page, pages viewed, approximate location derived from IP address, session duration, interactions with website features, and similar technical data.

Analytics providers may process information on our behalf subject to their applicable terms and our configurations.

We seek to configure analytics tools in a manner appropriate to their intended business purpose and applicable privacy requirements.

Current analytics provider(s): Zoominfo (https://www.zoominfo.com/)

10. How We Use Personal Information

We may use personal information for purposes reasonably related to providing and operating the Services, including providing OmniScope functionality; establishing and administering accounts; processing transactions; responding to inquiries; providing technical support; communicating service information; authenticating users; detecting fraud or misuse; maintaining system security; investigating incidents; debugging and troubleshooting; measuring performance; developing and improving services; performing analytics; maintaining business records; administering contracts; protecting our legal rights; complying with legal obligations; responding to lawful process; preventing unlawful activity; and carrying out other purposes disclosed when information is collected or otherwise permitted by law.

We may use information for a different purpose where permitted by applicable law or with appropriate authorization.

11. Disclosure of Personal Information

We may disclose personal information to the following categories of recipients when reasonably necessary for the purposes described in this Policy.

Service Providers and Subprocessors

We may use third-party companies to provide cloud hosting, storage, speech recognition, artificial-intelligence processing, software infrastructure, customer support, authentication, cybersecurity, payment processing, email delivery, analytics, telecommunications, and other operational services.

These entities may process personal information to perform services for us or our customers.

Where required, we impose contractual restrictions concerning their processing of personal information.

Affiliates

Information may be disclosed between Advanced Translations Technology, Inc., DepoDash, LLC, and their affiliated entities where reasonably necessary to operate, support, administer, secure, develop, or provide the Services.

Customer Organizations

If a user accesses OmniScope through an employer, reporting firm, court, agency, law firm, or other organization, we may provide that organization with account, usage, administrative, billing, or security information associated with its account.

Professional Advisers

Information may be disclosed to attorneys, accountants, auditors, insurers, financial advisers, consultants, and other professional advisers where reasonably necessary for legitimate business purposes.

We may preserve, access, use, or disclose information when we reasonably believe doing so is necessary or appropriate to comply with applicable law or legal process; respond to subpoenas, warrants, court orders, governmental requests, or regulatory inquiries; investigate or enforce agreements; protect the rights, property, security, or safety of the Company, our customers, users, or others; prevent fraud or unlawful conduct; establish or defend legal claims; or respond to an emergency.

Where permitted and appropriate, we may notify an affected customer before responding to legal process concerning Customer Content. We are not required to provide notice where prohibited by law, where immediate action is reasonably required, or where providing notice would be inappropriate under the circumstances.

Corporate Transactions

Information may be disclosed or transferred in connection with an actual or proposed merger, acquisition, financing, investment, restructuring, bankruptcy, sale of assets, corporate reorganization, change of control, or similar transaction.

Any successor receiving personal information remains subject to applicable privacy-law obligations concerning that information.

12. Subprocessors

OmniScope may rely upon third-party subprocessors to provide portions of the Services.

Subprocessors may include providers of:

  • cloud computing and hosting;
  • data storage and backups;
  • speech-to-text services;
  • artificial-intelligence and machine-learning infrastructure;
  • email and communications;
  • identity and authentication;
  • cybersecurity;
  • payment processing;
  • technical support;
  • application monitoring; and
  • analytics.

Our current subprocessor information may be available by contacting webmaster@omnirecord.com:

We may add, replace, or discontinue subprocessors as our technologies, vendors, and Services evolve.

Where a customer agreement provides specific subprocessor-notification or objection rights, those contractual terms apply.

13. Sale, Sharing, and Targeted Advertising

We do not sell Customer Content for monetary consideration.

We do not use Customer Content for cross-context behavioral advertising.

If our practices change in a manner that constitutes a sale or sharing under applicable law, we will provide legally required notices and choices.

Where applicable, we recognize qualifying browser-based opt-out preference signals, including Global Privacy Control, as required by law.

14. Sensitive Personal Information

Customer Content may incidentally contain sensitive personal information because legal proceedings can concern medical conditions, finances, identification numbers, immigration status, employment, family matters, criminal allegations, sexual conduct, religious beliefs, or other sensitive subjects.

We process sensitive information contained in Customer Content to provide the Services requested by the customer and for other purposes permitted by applicable law.

We do not use sensitive personal information contained in Customer Content to infer unrelated characteristics about individuals for advertising or marketing purposes.

Where applicable law provides a right to limit certain uses or disclosures of sensitive personal information, we will honor that right where the processing at issue is subject to that right.

15. Security

We employ administrative, technical, and organizational measures designed to protect personal information against unauthorized access, use, modification, loss, destruction, or disclosure.

Security measures may vary depending upon the nature of the information, the system involved, available technology, implementation costs, and reasonably foreseeable risks.

No security guarantee. No method of electronic transmission, computer storage, cloud computing, encryption, security technology, or information system can be guaranteed to be completely secure. Accordingly, we do not guarantee that unauthorized persons will never defeat our security measures or that personal information will never be accessed, disclosed, altered, corrupted, destroyed, intercepted, or lost.

Users are responsible for protecting their account credentials and devices and for promptly notifying us of suspected unauthorized account activity.

16. Data Retention

We retain personal information for periods reasonably necessary and proportionate to the purposes for which it was collected or processed, subject to legal, contractual, operational, security, and technical requirements.

Retention periods may depend upon the type of information, the applicable customer agreement, account configuration, customer instructions, legal requirements, dispute-resolution needs, security requirements, backup processes, and whether information is required to establish or defend legal claims.

Account and Business Records

We may retain account, billing, transaction, contract, tax, security, and business records after termination of an account where reasonably necessary for legitimate business purposes or legal compliance.

Customer Content

Retention periods for Customer Content may depend on the applicable service configuration, subscription, customer agreement, or customer instructions.

Customers should maintain their own copies of recordings, transcripts, and other materials they are legally, professionally, contractually, or operationally required to retain.

Important: OmniScope should not be relied upon as the sole archival repository for official recordings, transcripts, evidence, or other materials.

We may delete Customer Content following expiration of the applicable retention period, termination of an account, customer deletion instructions, nonpayment, discontinuation of a service, or other circumstances permitted by the applicable agreement and law.

Deletion from active systems does not necessarily result in immediate deletion from backups, disaster-recovery systems, security logs, legal holds, or systems in which immediate deletion is technically impracticable.

Residual copies may remain until overwritten, rotated, or deleted according to our normal backup and retention procedures.

We may retain information beyond an ordinary retention period if reasonably necessary to comply with law, legal process, court orders, investigations, audits, security obligations, dispute resolution, or the establishment, exercise, or defense of legal claims.

17. Customer-Controlled Information and Privacy Requests

A substantial portion of the personal information processed through OmniScope may be Customer Content that we maintain on behalf of a customer.

If your personal information appears in a proceeding recording, rough transcript, certified transcript, or other Customer Content, the applicable court reporter, reporting agency, court, law firm, governmental entity, or other customer may control that information.

In such circumstances, privacy requests concerning Customer Content should ordinarily be directed to the organization responsible for the proceeding or that submitted the information to OmniScope.

If we receive a request concerning information that we maintain solely on behalf of a customer, we may refer the request to that customer or assist the customer as required by applicable law and our contractual obligations.

We may not be legally authorized to independently alter, disclose, or delete Customer Content merely because an individual appearing in the content contacts us.

For example, legal, evidentiary, record-retention, court-order, professional, or contractual requirements may restrict alteration or deletion of transcript-related material.

18. California Privacy Rights

If you are a California resident and the California Consumer Privacy Act, as amended (“CCPA”), applies to the information at issue, you may have the following rights subject to statutory exceptions.

Right to Know and Access

You may request information concerning the personal information we have collected about you, including applicable categories of personal information, sources, purposes of processing, categories of recipients, and specific pieces of personal information.

Right to Delete

You may request deletion of certain personal information we collected from you, subject to applicable exceptions.

We may retain information where permitted by law, including where reasonably necessary to provide requested services, maintain security, complete transactions, comply with legal obligations, maintain records, exercise or defend legal claims, or for other legally permitted purposes.

Right to Correct

You may request correction of inaccurate personal information maintained about you, subject to applicable law.

Right to Opt Out of Sale or Sharing

If we sell or share personal information as those terms are defined by the CCPA, California residents may direct us not to sell or share their personal information.

We will also process qualifying opt-out preference signals, including Global Privacy Control, where required by law.

Right to Limit Use and Disclosure of Sensitive Personal Information

Where we use or disclose sensitive personal information in a manner that gives rise to a limitation right under the CCPA, California residents may request that we limit such use or disclosure.

Not every processing of sensitive personal information is subject to the limitation right.

Right to Nondiscrimination

We will not unlawfully discriminate against a person for exercising rights provided by applicable privacy law.

Authorized Agents

A California resident may use an authorized agent to submit certain requests.

We may require appropriate proof that the agent is authorized to act on the consumer's behalf and may take legally permitted steps to verify the request.

Verification

We may need to verify identity before processing certain privacy requests.

Verification procedures may vary depending on the nature and sensitivity of the requested information and the risk of unauthorized disclosure or deletion.

Information collected solely for verification may be used for verification, fraud prevention, security, and related legally permitted purposes.

19. Privacy Rights in Other U.S. States

Residents of certain U.S. states may have additional privacy rights when an applicable state privacy law applies to the Company and the information at issue.

Depending upon the applicable law, these rights may include rights to access personal information; obtain a copy of certain personal information; delete personal information; correct inaccuracies; obtain information concerning processing activities; opt out of the sale of personal information; opt out of targeted advertising; opt out of certain profiling in furtherance of decisions producing legal or similarly significant effects; limit or withdraw consent to certain sensitive-data processing; obtain a list of certain third parties or categories of third parties receiving personal information; designate an authorized agent; and appeal the denial of a privacy request.

Privacy rights vary by state, and statutory exceptions may apply.

We will honor applicable privacy rights to the extent required by the law governing the particular request.

If applicable law provides a right to appeal our decision concerning a privacy request, instructions for submitting an appeal will be included in our response.

20. Exercising Privacy Rights

Privacy requests may be submitted through the following methods:

Privacy Email: privacy@omnirecord.com

Toll-Free Number: (800) 966-1221

Mail: Advanced Translations Technology, 5115 Douglas Fir Road, Suite L, Calabasas, CA 91302

Please identify the nature of the request and provide sufficient information for us to locate the relevant records.

Do not send passwords, complete payment-card numbers, Social Security numbers, or other unnecessary sensitive information when making an initial privacy request.

We may request additional information where reasonably necessary and legally permitted to verify identity, locate responsive records, prevent fraud, or determine whether a request relates to information we control or Customer Content processed on behalf of another organization.

We will respond within the period required by applicable law.

We may deny, limit, or decline a request where permitted or required by applicable law, including where we cannot verify the request, the requested information is exempt, we process the information solely on behalf of another organization, complying with the request would violate another person's rights, or retention is legally permitted or required.

21. Global Privacy Control and Browser Signals

Where required by applicable law, we recognize qualifying opt-out preference signals, including Global Privacy Control (“GPC”), for requests to opt out of sale or sharing.

A browser-based signal may apply only to the browser or device from which it is sent unless applicable law requires or available technology permits us to associate the signal with an authenticated account.

We do not interpret ordinary browser “Do Not Track” signals as privacy requests unless applicable law requires us to do so.

Our websites or Services may contain links to websites, applications, integrations, or services operated by third parties.

Third parties maintain their own privacy practices, terms, and security measures.

We are not responsible for the privacy practices, content, security, availability, or conduct of independently operated third-party services.

Users should review the applicable third party's privacy policy before providing information directly to that party.

23. International Processing

Our Services and service providers may process or store information in the United States and in other jurisdictions in which we or our service providers operate.

Privacy and data-protection laws may differ between jurisdictions.

Where applicable law requires a particular mechanism for international transfer or processing, we may employ contractual provisions or other legally recognized safeguards.

24. Children

OmniScope is a professional service and is not directed to children.

We do not knowingly offer OmniScope accounts directly to children under 16.

Customer Content may contain information concerning minors because minors can be witnesses, litigants, family members, or subjects of legal proceedings. Such information is processed on behalf of the applicable customer as part of the professional services requested by that customer.

The presence of information concerning a minor in Customer Content does not mean that the minor is an OmniScope user.

If we learn that personal information was collected directly from a child in a manner requiring parental authorization under applicable law, we will take appropriate steps consistent with our legal obligations.

25. Email and Communications

We may send administrative and transactional communications relating to accounts, subscriptions, security, billing, system availability, service changes, and customer support.

Users may also receive marketing communications where permitted by law.

Marketing communications may contain an unsubscribe mechanism.

Opting out of marketing communications does not prevent us from sending non-marketing communications reasonably necessary to administer an account, provide requested services, address security matters, or comply with law.

We may receive subpoenas, warrants, court orders, governmental demands, litigation requests, or other legal process seeking information.

We evaluate such requests in accordance with applicable law and our legal obligations.

We reserve the right to preserve and disclose information where our attorneys or authorized personnel determine that preservation or disclosure is required or permitted by law.

Nothing in this Privacy Policy requires us to challenge legal process, provide advance notice, or incur expense on behalf of a customer unless a separate written agreement expressly provides otherwise.

27. Changes to This Privacy Policy

We may modify this Privacy Policy from time to time to reflect changes in our Services, technologies, business practices, vendors, legal requirements, or other circumstances.

The “Last Updated” date above identifies when this Privacy Policy was most recently revised.

Where required by applicable law, we will provide additional notice of material changes.

Continued use of the Services after an updated Privacy Policy becomes effective does not waive any privacy right that applicable law makes non-waivable.

28. Accessibility

We intend for this Privacy Policy to be reasonably accessible to individuals with disabilities.

A person who requires this Privacy Policy in an alternative format may contact us using the information below.

30. California Notice at Collection

For California residents, this Section also serves as a general summary of our collection practices.

We may collect identifiers; customer and commercial information; professional information; billing information; internet and electronic activity; communications; security information; audio and audiovisual information; transcript and proceeding information; inferences and analytical information; and sensitive personal information that may appear in Customer Content.

We collect and process these categories for the purposes described in this Privacy Policy, including providing and securing OmniScope, administering accounts and subscriptions, processing payments, providing customer support, performing transcript-related processing requested by customers, detecting and preventing security incidents, troubleshooting, maintaining and improving the Services, complying with law, and protecting legal rights.
